These are the general terms and conditions on our app, Utool, if you use our app, you agree to abide by these terms.
1. Age restrictions
Our app is designed for the user over 13 (or such applicable age of majority under relevant local laws of the user) [“specific age”]. If you are under the specific age, please read these terms with your parents or legal guardian.
If you are the parents or the legal guardian, you allow your child to use our app, you and your child will be bound to these terms.
2. Intellectual property
Unless otherwise stated all the services offered by our app including but not limited to the stickers, music, fonts are offered under open content, copyright licenses or created by ourselves and you should refer to the provisions of the license in question to find out what you are allowed to do. Some of our content belongs to third parties. Most third-party data is subject to an open license, but we cannot guarantee it. You should refer to the third party if you are in doubt.
AI-Generated Content Disclaimer
Before using our AI features, you should be fully aware and agree to the following: Due to the limitations and nature of artificial intelligence technology, we cannot ensure that the generated content is accurate or suitable. Users are responsible for evaluating the content themselves and assuming all related risks and legal consequences. Should you encounter any content you find inappropriate, please contact us to improve our services.

You must ensure that you use this service and any AI-generated content in compliance with applicable laws, and without infringing any third party’s copyrights, trademarks, or other legal rights. You shall not use AI-generated content for any illegal purposes. If your improper use causes damage to any third party’s rights, you shall bear the corresponding legal liabilities.
AI-Generated Content is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability or any specific outcome, and we expressly disclaim all warranties, whether express or implied, including but not limited to fitness for a particular purpose or non-infringement.

Within our application, the music albums credited to AI Music are created using artificial intelligence technology. It's imperative to emphasize that these albums are intended strictly for enriching your personal experience, non-commercial use, aligning with our commitment to respect intellectual property rights.
While we strive to uphold intellectual property rights, the complexities of AI-generated content and copyright laws mean we cannot guarantee freedom from infringements. Your use of these albums implies acceptance of associated risks. Rest assured, we're dedicated to addressing any concerns promptly.

3. Rights and restrictions
You have a non-exclusive right to use our service. And you retain any intellectual property rights that you have in your content such you created by yourselves (“your work”) through our app. We will not claim the exclusive right to your work.
When you use our app to create content, you may not:
Otherwise, we reserve the right to terminate these terms signed between you and us. Examples include child pornography, content that facilitates human trafficking or harassment, and content that infringes someone else's intellectual property rights.
4. Third party content and service
We work with third-party to offer better service for you. But we can't 100% guarantee the quality and level of the service they provide. We do not guarantee the service provided by the third-party in any manners. We have no responsibility for any promise, statement or behavior made by the third-party to you. When you use third-party services, please read carefully terms of use, license agreement and other policies or terms (“terms and policies”) that the third party requires you to comply with. We are not liable for any loss which is caused by your behavior that breaches the third-party's terms or policies.
5. AI Services Usage Policy
You may not use the AI features to create, upload, share, or distribute content that is pornographic, violent, abusive, misleading, discriminatory, unlawful, or otherwise violates the rights of any third party, including intellectual property and privacy rights.
Enforcement Mechanism
We reserve the right to assess flagged content and related activity. We may use automated safety filters to detect, block, restrict, or remove content that may violate this Policy. If we identify or reasonably suspect a policy violation, we may block, restrict, or remove the offending content from our platform, and we reserve the right to issue warnings or usage restrictions to maintain a safe environment. You acknowledge and agree that our app shall not be liable for any loss of data or content resulting from such enforcement actions.
If you identify any AI-generated content that may violate this Policy, you may report it to us through the in-app feedback feature or other contact information provided by our app. We will continue to improve our content filtering, review, and safety protection mechanisms based on user feedback.
6. Payment
Unlocking certain premium content or features of our service is made possible through subscription, granting you access to a wide array of premium features designed to enhance your experience. It's important to note that your subscription is set to automatically renew for your convenience. However, should you wish to opt out of this renewal, you have the flexibility to do so up to 24 hours before the current subscription period expires.
You can cancel your subscription at any time during the free trial period (if available) to avoid charges.
Moreover, please note that subscriptions are platform-specific and cannot be transferred between different operating systems. As such, the benefits of your subscription are valid solely within the iOS system.
7. Credits
Credits are virtual tokens used for certain AI features. Credits have no cash value and are not redeemable for cash, unless otherwise required by law or applicable platform policy.
Subscription bonus Credits (if any) are granted in connection with an active subscription and may become unavailable or expire in accordance with applicable rules when the subscription is inactive. Credits may expire and are consumed from the earliest-expiring batch first. Purchases are generally platform-specific.
Credits are generally non-refundable, except as required by applicable law or store policy. Refunds or chargebacks may result in the revocation of associated Credits.
If any abnormal acquisition of Credits, fraud, exploitation of vulnerabilities, or malicious refunds or chargebacks are discovered, we reserve the right to freeze Credits, restrict usage, suspend or terminate services, and pursue legal action where permitted by law.
We may modify Credits pricing, expiration terms, and redemption rules due to operational, compliance, or product reasons, to the extent permitted by applicable law. Any material changes will be notified in a reasonable manner.
8. Privacy
We attach great importance to your privacy security. You can learn what information we collect, how we use it and what choices you have about it by reading our Privacy Policy.
9. Disclaimer
We will try our best to provide you wonderful service and keep the services up and running and free of annoyances. But we make no promises that we will succeed.
The services are provided “as is” and “as available” and to the extent permitted by law without warranties of any kind, either express or implied, including, but not limited to, implied warranties of fitness for a particular purpose, title, and non-infringement. In addition, while we attempt to provide a good user experience, we do not represent or warrant that: (1) the services will always be secure, error-free, or timely; or (2) the services will always function without delays, disruptions, or imperfections.
Neither we nor our affiliates take responsibility or assume liability for any content that you, another user, or a third party creates, uploads, posts, sends, or stores on or through our services.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, punitive, or multiple damages, or any loss of data, use, goodwill, or other intangible losses, resulting from: (1) your use of our app; (2) the service offered by the third-party.
11. Termination
You can terminate these terms at any time and for any reason by uninstalling our app.
We may terminate or temporarily suspend your access to our app if you fail to comply with these terms or the laws, for any reason outside of our control without notice.
Whether these terms are terminated or not, the section 2, 4, 5, 6, 7, 8 , 9 and 10 still effect.
12. Dispute resolution
Any dispute, controversy or claim (whether in contract, tort or otherwise) arising out of, relating to, or in connection with these Terms, including their existence, validity, interpretation, performance, breach or termination, will be referred to and finally resolved by the people's court at the place of domicile of the defendant.
13. Change
We may update these terms at any time. If we do so, we will display the pop-up to notify you. Any changes will be binding on you from the moment you continue to use our app.
